These Terms are an agreement between you and Butlr Home Services LLC ("Butlr"). By texting Butlr or using our website, you agree to these Terms and our Privacy Policy.
1. What Butlr does
Butlr is a booking service. You text us what you need and when you're available, and we schedule an independent home service professional ("Provider") to do the work.
Butlr does not perform home services. Providers are independent businesses, not Butlr employees or agents. Your contract for the work is with the Provider.
2. Not for emergencies
Butlr is not an emergency service. For fire, gas leaks, flooding that threatens safety, or any danger to life or property, call 911 or your utility company first.
3. Eligibility
You must be at least 18 and have authority to request work at the service address.
4. SMS messaging program
• Program: Butlr Booking Messages.
• Description: texts about your service requests, including booking confirmations, appointment reminders, schedule updates, and customer support.
• How you opt in: by texting Butlr or by submitting your number on our website and checking the consent box.
• Frequency: message frequency varies based on your requests.
• Cost: Message and data rates may apply.
• Opt out: reply STOP at any time. You will receive one confirmation text and no further messages unless you opt in again.

• Carriers: carriers are not liable for delayed or undelivered messages.

5. Your responsibilities
• Give accurate information about the job, address, and availability.
• Provide safe access to the property at the scheduled time.
• Treat Providers and Butlr staff with respect.
• Do not use Butlr for anything illegal, abusive, or fraudulent.
6. Scheduling and cancellations
We try to match your preferred times but cannot guarantee availability. To cancel or reschedule, text us as early as possible. Providers may apply their own cancellation fees. Bultr may apply cancellation fees or rescheduling fees.
8. Provider work
Providers are solely responsible for the quality, safety, licensing, insurance, pricing, and warranties of their work. Any claim about the work, including damage or injury, is between you and the Provider. We may, at our discretion, help you communicate with the Provider to resolve an issue.
9. Disclaimers
Butlr is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that any Provider will be available or that the work will meet your expectations.
10. Limitation of liability
To the fullest extent allowed by law, Butlr is not liable for indirect, incidental, special, consequential, or punitive damages, or for any act or omission of a Provider. Our total liability for any claim is limited to the greater of the fees you paid Butlr in the 12 months before the claim or $100.
11. Indemnity
You agree to defend and hold Butlr harmless from claims arising from your misuse of the service, your violation of these Terms, or your dealings with a Provider.
12. Disputes
Governing law: the laws of the State of Idaho, without regard to conflict-of-law rules.
Informal resolution first: before filing a claim, contact us via email and give us 30 days to resolve it.
Arbitration: any unresolved dispute will be settled by binding individual arbitration under the American Arbitration Association Consumer Rules. You may bring qualifying claims in small claims court instead.
Class action waiver: you and Butlr agree to bring claims only individually, not as a plaintiff or class member in any class or representative action.
Opt out of arbitration: email us within 30 days of first using Butlr stating that you opt out.
13. Termination
We may suspend or end your access if you violate these Terms or misuse the service. You may stop using Butlr at any time by replying STOP.
14. Changes
We may update these Terms. We will post the new version with a new effective date. Continued use after changes means you accept them.
